Madame Pamplemousse is an online shop creating and selling jewelry.

All orders on the website are subject to these general terms and conditions of sale. These are subject to changes and updates, the conditions applicable to the order of a product by a customer are those in force on the day of the order. These general terms and conditions of sale are subject to French law.

These general terms and conditions of sale govern the sales carried out by Madame Pamplemousse and specify the conditions of order, payment, delivery and management of any returns of the products ordered by the Customers.

The general terms and conditions of sale are made available to Customers on the website where they can be consulted.

The general terms and conditions of sale are binding on the Customer who becomes aware of them before the implementation of the order procedure.

2- The Customer

The customer of the website must be a consumer, major natural person and legally capable. The customer must, during his first order on the website, complete an order form specifying certain mandatory fields so that his order of products can be taken into account by Madame Pamplemousse.

The information communicated to Madame Pamplemousse during each of her orders must be complete, accurate and up-to-date. If necessary, Madme Pamplemousse may ask the client for confirmation – by any means – of this information and her identity.

Madame Pamplemousse reserves the right not to proceed with orders that do not comply with its trade policy.

3- Products

Each product proposed on the website is accompanied by one or more photographs, a text description of the materials and colors, this information is not contractual.  The descriptions and photographs of the products sold on the website are as accurate and as true to reality as possible. However, the colours, dimensions, textures and other characteristics of the Products may be altered by the screens or web browsers used to view them.

The Customer thus acknowledges that the photographs, descriptions or graphics accompanying and illustrating the products offered for sale on the website are indicative and non-contractual and cannot engage the Seller’s liability in case of error, omission or modification. However, Madame Pamplemousse undertakes to ensure that the photographic representation of the products on the website is as faithful as possible to the product.

The sale takes place within the limits of the company’s available stocks. The latter may not be held responsible for shortages of stock or the impossibility of selling a product whose stock is non-existent.

4- Ordering procedures

The placing of an order on the website is subject to compliance with the procedure set up by Madame Pamplemousse on the website including successive steps leading to the ordering and conclusion of the sales contract:

The Customer can select as many Products as he wishes, these will be added to the cart. The shopping cart summarizes the products chosen by the Customer as well as the prices and related costs. The Customer may freely modify the shopping cart before validation of his order.

The validation of the Order constitutes an irrevocable acceptance which can only be called into question within the limits provided by these general conditions of sale. It automatically entails the acceptance of the products purchased, their price, the associated fees and the general terms and conditions of sale by the Customer. The validation of the Order concludes the sales contract.

In order to place an order, the Customer undertakes to communicate via the Website only the actual and valid information necessary for the performance of the service covered by these Terms and Conditions. The Seller cannot be held responsible for the erroneous information transmitted by the Customer resulting in the non-performance of the service covered by these Terms and Conditions. 

Any order will be deemed validated only after acceptance of payment. The Seller shall have the right to refuse or cancel any order relating to a Customer in dispute on a previous order.

A confirmation email summarizing the order (products, price, quantity, etc.) will be sent to the Customer by Madame Pamplemousse. To this end, the Customer formally accepts the use of electronic mail for the confirmation by Madame Pamplemousse of the content of his order.

5- Prices and methods of payment

Price:

The prices displayed on the Website are expressed in euros, all taxes included (French VAT and other taxes applicable on the day of the order). Packing, order processing and shipping costs are included in the price for delivery to France. For delivery abroad, shipping charges will be added to the selling price. Packaging, processing and shipping costs are indicated before the validation of the order.

The Seller may change the prices of the products at any time and without notice, in particular due to changes in the economic, legislative and fiscal framework. The products are invoiced on the basis of the tariff in force at the time of validation of the order. The telecommunications costs necessary to access the Seller’s Website are borne by the Customer.

The products remain the property of the Seller until full payment of the product.

Methods of payment:

Payment by card

The Customer can make the payment by payment card. Cards issued by banks domiciled outside France must be international bank cards (Mastercard or Visa).

The bank details are collected by Stripe, which complies with the PCI DSS (Payment Card Industry Data Security Standard). It ensures the confidentiality and integrity of cardholder data, and secures the protection of card and transaction data. Your bank data is encrypted using TLS technology, so it will not circulate over the Internet and cannot be intercepted. Madame Pamplemousse does not keep your bank details.

In order to validate the payment, the user must indicate the name of the cardholder as well as the number of the card, its expiry date and the cryptogram on it (3-digit code allowing the security of the transactions).

Once the payment has been validated by the Customer, the transaction is immediately debited after verification of the information. In accordance with Article L. 132-2 of the French Monetary and Financial Code, the commitment to pay given by card is irrevocable. By providing its banking information at the time of the sale, the Customer authorises the Seller to debit its card the amount relating to the price indicated. The Customer confirms that he is the legal holder of the card to be debited and that he is legally entitled to make use of it. In case of error, or impossibility to debit the card, the Sale is immediately resolved by right and the order cancelled. If applicable, a notice of cancellation of an order for default of payment is sent to the Customer by Madame Pamplemousse on the email address communicated by the Customer when registering on the website.

Payment by bank transfer

You can also contact us to make a payment by bank transfer. Orders made through this method are only taken into account after receipt of the transfer.

Payment by PayPal

The Customer may also pay for his purchases on the website by Paypal. The data recorded by Paypal constitute the proof of the financial transactions carried out by this method of payment. Paypal does not transmit confidential payment information to Madame Pamplemousse.

6- Deliveries

In accordance with the provisions of Article L 121-20-3 of the French Consumer Code, the Products ordered are delivered within the deadlines indicated on the Website.

The deadlines indicated on the website are only indicative and correspond to the average time of processing and delivery of the parcel.

If the part you have selected is in stock, it will be sent to you within 5 business days from the date of purchase. If we need to create it, we will send it to you within 2 to 4 weeks.

In the event that the parcel is damaged upon delivery, the Customer must check in the presence of the carrier the condition of the products of his order and indicate precisely on the delivery note of the carrier any reservation in case of missing or damaged article.

No delivery can be made to the address of a hotel or a post office box. 

During periods of high attendance such as Christmas, Madame Pamplemousse reserves the right to extend the shipping time.

It is specified that any change of delivery address made by the Customer after the registration of the order may lead to an extension of the delivery time.

As Madame Pamplemousse and the carriers are separate and independent entities, Madame Pamplemousse cannot be held responsible for any delay and error in delivery or loss of packages attributable to Colissimo or a carrier.

Availability of service and products:

We detail here the delivery costs according to your destination:

France: free
Europe: €15
United Kingdom: 20€

The brand reserves the right to cancel an order in case of circumstances external to the brand that may make delivery in the destination countries difficult. In this case, you will receive an email communicating it and the amount will be fully refunded.

7- Right of withdrawal and repayment terms

If the customer is not satisfied with the products, he has a right of withdrawal of 14 clear days from the day of receipt of his order to return one or more articles, without justifying the reason. The withdrawal period shall expire 14 days after the day on which he or a third party other than the carrier and designated by the buyer physically takes possession of the property.

The returned product or products must be new, not worn, not used or otherwise used, and in their original packaging, accompanied by a copy of the invoice. Otherwise the package will be returned. The Customer organizes the return at his convenience, at his expense and at his risk by Colissimo or carrier at the following address:

It is therefore advisable to provide proof of this return, which presupposes that the products are returned with tracking of parcels, or by any other means giving certain date.

The exchange is not accepted.

Any customs charges related to the return of product from a foreign country are also borne by the customer.

Upon receipt, and subject to these conditions of return, the seller will make the refund of the order excluding initial shipping costs by credit to the bank account of the customer within 15 days after receipt of the parcel by the seller.

Failing to comply with the present conditions of return, the parcel will be returned to the customer at his expense and will not be refunded. The following are excluded from any warranty:

– Non-compliant uses and maintenance, and faults in use or maintenance.

– Deterioration due to manipulation error, improper or abnormal use, intentional or accidental physical modification, use for business or commercial purposes.

– Deterioration due to an external event.

– The interventions carried out on the jewel by any person not mandated by our after-sales service aswell as the deterioration following such intervention.

The refund will be made by bank transfer to the card used to pay the initial invoice. As part of the shipping costs offered, the amount of these costs will be deducted in case of reimbursement.

8- Guarantees

The Products benefit from the legal guarantee of conformity as well as the legal guarantee of hidden defects. Abnormal or non-compliant use of the products, as well as the consequences of such uses or external causes are excluded from the scope of contractual guarantees.

For access to the website as well as for all stages of the purchase process, from order to shipment as well as for subsequent services, the Seller has only an obligation of means and its liability cannot be incurred for any inconvenience or damage inherent in the use of the internet network, in particular a break in service, an external intrusion or the presence of computer viruses or any case of force majeure.

9- Protection of personal data

The personal information relating to the Customer is essential for the processing and routing of orders, and the preparation of invoices.

Madame Pamplemousse agrees not to disclose to third parties the information communicated by the Customers on the site. These are confidential. They will only be used for the processing of his order and the monitoring of commercial relations and will be treated in complete confidentiality taking into account the personal data communicated by the Customer.

In accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016), you have the right to access, correct and oppose personal data concerning you. To do so, simply send us a request by e-mail to contact@madamepamplemousse.com, indicating your first and last names and justifying your identity.

10- Intellectual property and copyright.

All publications and information on the website www.madamepamplemousse.com: texts, documents, photographs, designs, graphic representations, databases, videos, logos, trademarks, trade names or other distinctive signs, etc. are protected by copyright, patents and other intellectual property filings owned by Claudia TUFFIGO. None of these elements may be modified, used, borrowed, reproduced or copied without the permission of Claudia TUFFIGO, owner of the trademark Madame Pamplemousse.

10- Applicable law, language and disputes

These General Conditions and accepted orders are subject to French law. The language of these Terms and Conditions and accepted orders is French. In the event of a dispute, the French courts shall have sole jurisdiction.
